In forensic cases, the client is usually the attorney who
initiated the services. According to the Specialty Guidelines for
Forensic Psychologists (APA, 1990), forensic psychologists are not
to provide services to a defendant or any other party involved in a legal
proceeding until that individual is represented by legal counsel. Therefore,
all fees for services are billed to the attorney’s law firm and not to the
attorney’s client. In addition, the Specialty Guidelines for Forensic
Psychologists specifies that forensic psychologists cannot provide
forensic services on a contingency fee basis. |

Thus, Dr. Weiss never bills the attorney’s client nor are
contingency fee arrangements ever accepted. |

Once the decision is made to retain Dr. Weiss to work on a
forensic case, a retainer agreement is forwarded to the attorney requesting
services and a non-refundable retainer is collected to cover ten hours of
work for all forensic services. Forensic services include forensic
interviewing, psychological testing, test scoring and interpretation, record
review, written report preparation, psycho-legal consultation, and expert
witness testimony at deposition or in court. After the retainer funds have been
exhausted, Dr. Weiss bills the responsible party at an hourly rate for
services on a monthly basis. Payment for these services is due upon
receipt of the billing statement. Dr. Weiss charges a daily flat fee for all
out-of-town cases plus travel expenses. |

Dr. Weiss sometimes accepts cases from agencies that have set
fees that are lower than her regular fees. However, these determinations are
made on a case-by-case basis. Dr. Weiss is on the court-appointed expert
witness lists in both Broward and Dade counties. She does accept court
appointments, referrals from the Public Defenders' and State Attorneys'
Offices, and referrals from court appointed attorneys/specially appointed
Public Defenders. Please contact our office to further discuss these
